AIC submits comments on amending and supplementing provisions to the Version 5.0 of Decree No. 06/2016/ND-CP (“Draft Decree”) on management over, provision and use of, radio and television services. With the hope that Ministry of Information and Communications (“MIC”) will find it helpful as they review the Draft Decree, we encourage the authorities to consider immense potential of Internet platforms and on- demand services in Vietnam. Importantly, the regulatory approach should be aligned with Vietnam’s digital economy goals, which could translate into local growth opportunities and innovation.
We note that in its approved master plan to 2020 on the development of radio and television services in Vietnam (under Decision 1448/QD-TTg as approved by the Prime Minister), Vietnam has recognised that a solution to improving its legal framework and mechanisms in this sector is to “[formulate and amend] the standards and regulations on radio and television services in conformity with Vietnam’s development and international practices”. Our submission has been prepared with this roadmap in mind, as we seek to provide our suggestions that will aid the Ministry in alignment with such international practices.
